Child Rights and Wellbeing Impact Assessment (CRWIA) for the Coronavirus (Recovery and Reform) (Scotland) Bill.


1. Which articles of the UNCRC does this policy/measure impact on?

All UNCRC rights are underpinned by the four general principles: non-discrimination; the best interests of the child; the right to life, survival and development; and the child's right to have their views given due weight.

This section of the CRWIA highlights the articles of the UNCRC and Optional Protocols which are relevant to the provisions included in the CRWIA. Further information regarding the UNCRC and its articles is available at the Annex of this CRWIA.

Modifications of the Public Health etc. (Scotland) Act 2008

The public health protection provisions contained within the Bill are enabling powers and do not, themselves, impact on any articles of the UNCRC.

The full impact of any interaction with UNCRC articles will only be understood when public health regulations are made, but given the regulations are to be made to protect the public against a significant health threat, it is most likely that those regulations will impact on Article 6. Depending on the content of any regulations, other articles could also be impacted, for example Article 15.
