12. Breach Applications of Supervised Attendance Orders (table 38 to table 39)

12.1 This section provides information on breach applications of Supervised Attendance Orders made to the courts between 1 April 2002 and 31 March 2003.

12.2 824 breach applications were made to the Courts in 2002-03 in respect of Supervised Attendance Orders for a total of 686 individuals. This compares to 871 applications for a total of 705 individuals in 2001-02.

12.3 The number of breach applications is not directly comparable with the number of orders provided previously (which covers new orders only) as some of the breach applications may relate to orders started in the previous year. However, as Supervised Attendance Orders are expected to be completed within a 12 month period (and usually within 6 months), the number of orders started in 2002-03 (2,700) can be taken as a proxy measure for the number of orders active during the year. This suggests that roughly one in three orders result in a breach application.

12.4 Seventy two per cent of breach applications were made to Sheriff Courts and a further 28% were made to District Courts. The majority of breach applications (87%) were made in respect of males.

12.5 In 2002-03, 11% of breach applications resulted in the original order being revoked and a custodial sentence being imposed, compared to 19% in 2001-02. A further 13% were continued without further action and 10% were continued with hours varied. The outcome was not yet known for 33% of breach applications.
