9. Breach Applications of Probation Orders (table 27 to table 29)

9.1 This section provides information on breach applications of Probation Orders (including Probation Orders with a Requirement of Unpaid Work) made to the courts between 1 April 2002 and 31 March 2003.

9.2 2,491 breach applications were made to the Courts in 2002-03 in respect of Probation Orders, compared to 2,452 in 2001-02. Improvements in data quality in several councils have resulted in increased recording of breach applications. As a result, the figures from 2000-01 onward are not directly comparable with those for 1999-00 (see Annex, paragraph 17.14).

9.3 The number of breach applications is not directly comparable with the number of orders provided previously (which covers new orders only) as some of the breach applications may relate to orders started in previous years. However, a rough estimate of the number of orders running during the year can be made using information on the length of orders started in 2002-03 (from table 22). This gives an estimated total of 9,254 Probation Orders running in 2002-03, which suggests that around one in four orders result in a breach application.

9.4 Just over 16% of breach applications resulted in the original order being revoked and a custodial sentence being imposed. A further 18% resulted in the original order being revoked and some other action being taken. In 11% of applications the original order was continued and no further action was taken by the court and in 37% of applications, the outcome was not yet known.

9.5 Males accounted for 82% of breach applications. The majority of breaches (56%) were caused by non compliance, 36% by a further offence (committed during the period of the Probation Order) and the remainder resulted from both non compliance and a further offence.

9.6 722 of the breach applications related to Probation Orders with a Requirement of Unpaid Work. The condition of Unpaid Work was breached in 63% of these cases.
