or given Non-Custodial Sentences in 1995, Scotland

7. Focus on Violent Offenders

7.1 The index crime was a crime of violence for 12,527 (23 per cent) of the 54,712 offenders with an index conviction in 1995. The common law offence of simple assault accounted for just over three-quarters (77 per cent) of these offenders. Some summary details for this group of offenders are given in the box below.

7.2 Of those offenders with an index conviction for violence in 1995, males aged under 21 were the most likely to be reconvicted within two years, with 56 per cent reconvicted. The two-year reconviction rates were relatively high for those convicted of robbery (62 per cent), having in a public place an article with a blade or point (53 per cent) and possession of an offensive weapon (46 per cent)

7.3 The likelihood of a reconviction for violence was highly associated with the number of previous convictions for violence held by the offender. For example, two-thirds (67 per cent) of the 70 offenders who had over 10 previous convictions for violence at the time of their index conviction in 1995 were reconvicted for a further crime of violence within two years (for an average of just under 3 offences of violence in total). The corresponding rate for the 8,210 offenders who had no previous conviction for violence was 20 per cent. For offenders with an index conviction for violence in 1995, the proportion reconvicted within two years for a violent crime was higher for those who had been discharged from a custodial sentence (35 per cent) and probation (31 per cent) than for other types of disposal. Offenders whose index conviction for violence in 1995 was in a sheriff summary or district court were less likely to be reconvicted for violence within two years (19 per cent reconvicted) than those convicted in the High Court or a sheriff solemn court (25 per cent).
