Welcome, introductions and apologies

CS welcomed everyone to the Health and Social Care Data Board meeting.

CS introduced new member Alan Bell to the Board and invited him to introduce himself and his interests in the use of data to improve health and social care in Scotland.

CS invited AK to introduce himself in his new role as Chief Data Officer for NSS.

Apologies were noted from Marion Bain, Imme Jones, Susan Cloke, Ruth Griffith and Mavis Machirori.

Minutes and action log

The board noted:

  • the updated terms of reference has been published on the HSC Data Board page on our website
  • the minutes from last Data Board meeting held on 03 May have been published on the HSC Data Board page on our website
  • all outstanding action log items have been completed

Next steps:

  • ToR needs to be updated when new members join the board. RA to action

National information governance programme of work for health and social care

PR and EN presented the National Information Governance (NIG) programme of work to the board. Although this programme is specific to health and care it will seek to inform best practice in information governance across government.

The board noted:

  • an Information Governance Review was undertaken which has resulted in a new NIG programme being developedThe NIG programme seeks to address and implement the key recommendations set out in the review
  • the goals of the NIG programme are:
    • to develop a more balanced, federated IG model
    • to conduct an IG maturity pilot to identify and address the gaps, to help mature IG across the health and care ecosystem
    • to empower people in their data and digital roles
    • to enable IG – ensuring the right tools for each IG task
    • to enhance transparency and trust through transformative-participatory public engagement
  • progress so far on the NIG programme and that EN is currently developing a plan to identify short- and long-term deliverables
  • the Scottish Approach to Service Design which empowers the people of Scotland to actively participate in the definition, design and delivery of their public services. will be used appropriately throughout the programme, linking into the wider work of the Data Strategy. This is in line with our principles of transparency and empowering the public to have voice and agency in policy design

The board discussed:

  • aligning the work of the NIG programme with that of key stakeholders to take a multiagency approach
  • the opportunity to conduct a scoping exercise with national and regional safe havens to consider the wider implications of IG across health and social care and ensure there is no duplication of work
  • the development of a stakeholder engagement strategy with key groups to ensure the right people are involved with the programme of work
  • the importance of data quality, assurance and governance to ensure we have good data integrity and security

The board was asked:

  • to provide approval for a NIG Programme Board to be established for this programme of work
  • to provide governance for the NIG programme

The board agreed:

  • to govern the NIG programme of work and a NIG Programme Board should be set up

Next steps:

  • future discussion on career pathways to be brought to Data Board, RA to add item to backlog
  • PR, EN and CB to have a follow up conversation with respect to engagement with Local Government

Data strategy update

CB and RA presented an update on the progress of the Data Strategy for Health and Social Care.

The board noted:

  • the Data Strategy team have engaged with stakeholders through a variety of communication methods such as email, engagement sessions and social media platforms to inform and encourage responses to the formal consultation for the Strategy
  • the formal consultation closed on 12 August 2022, 162 responses were received
  • the responses received for the consultation are now being analysed and the findings will be published on Citizen Space
  • the key themes emerging from the engagement sessions undertaken are:
    • Ethical Approach to Data
    • Data Access
    • Technology and Infrastructure
    • Skills, Talent and Culture
    • Insight
    • Industry, Innovation and Research
    • Information Governance and Security
    • Data Standards and Interoperability

Next steps:

  • begin drafting based on the key themes identified from the analysis of the consultation responses and the engagement sessions to date
  • develop a series of workshops with key stakeholders to identify commitments for the Data Strategy
  • undertake relevant impact assessments
  • develop a publication and communication plan for the Strategy
  • proposed revised timescales for publishing the Strategy

The board was asked:

  • to approve the extension of the timeline for the Data Strategy from autumn 2022 to early 2023 due to resourcing constraints
  • to agree that the next steps for the Data Strategy are appropriate

The board agreed:

ICD-11 wider implementation

GW and JW provided an overview of ICD-11 implementation and the risks associated with wider implementation within mental and physical health.

The board noted:

  • that the World Health Organisation (WHO) agreed to implement ICD-11 at the World Health Assembly in 2019As the UK is a member of the WHO they have an obligation to implement ICD-11 and as Scotland is part of the UK, this also applies in Scotland
  • ICD-10 is the current approved UK version 
  • as of January 2022, the WHO can accept data in ICD-11 format and expects member countries to work towards implementation
  • from November 2022, Health Boards in Scotland should implement ICD-11 for clinical diagnosis within mental health however ICD-11 data is not currently being collectedAs an interim solution coder will map diagnosis contained within patients notes to ICD-10 codes for the purposes of collecting data for Scottish Morbidity Records
  • NHS Digital is beginning initial engagement with stakeholders regarding implementation of ICD-11 and PHS are sighted on how this work is progressing in England
  • wider implementation of ICD-11 is a substantial change and will require a programme of work to establish the details of how the health sector would implement ICD-11
  • that implementation of ICD-11 in Scotland is expected to take up to five years

The board was asked:

  • to give approval for the Data Strategy to commit to starting a programme of work for the wider implementation of ICD-11

The board agreed:

  • the Data Strategy to set out a commitment to begin a programme of work for the wider implementation of ICD-11

Next steps:

GW/JW to provide the Board with further information regarding the options, risks and recommendations for wider implementation of ICD-11This will be brought back to the Data Board once options, risks and recommendations have been appropriately developed

Cyber security

JC provided an update on the Cyber Security incident impacting NHS Scotland and Care Sector software supplier.

The board noted:

  • the incident is still under investigation to understand the full impact
  • a full update will be received in due course highlighting any associated action plans relating to matters overseen by the Data Board

the Scottish Government is working closely with the Information Commissioners Office and organisations who have been potentially impacted

AOB and close

ETB will continue to provide oversight of the CHI programme of work however how the new CHI Management Board runs oversight of the use of CHI for data linkage will be governed by the Data Board

Part 2 of the National Care Service Bill should be added to the list of future agenda itemsRA to add this item to the backlog.
