An Open Scotland

 

Foreword by the Deputy First Minister and Minister for Justice

The Scottish Executive is committed in the Partnership Agreement and the Programme for Government to the early introduction of an effective Freedom of Information regime. Scottish legislation providing a right of access to information held by Scottish public bodies will be introduced to and scrutinised by the Scottish Parliament. This consultation document is the first step to achieving the distinctive Freedom of Information regime which I believe Scotland deserves. Openness is central to a modern, mature and democratic society and serves to strengthen government and empower people. At the heart of our proposals is a presumption of openness and a belief that better government is born of better scrutiny.

There are of course circumstances where information must be protected. Effective openness therefore involves a careful balance between the public's right of access to official information and the need to ensure that sensitive information is protected. I remain committed, however, to ensuring that the scales tip decisively in favour of openness.

I consider it essential to have a thorough and informed debate on the way forward on Freedom of Information policy in Scotland. We do not have a monopoly of good ideas and I look forward to receiving comments on the proposals contained in this document.
