If you are successful in recovering maintenance, the payments are normally sent to you automatically from the country of origin. Most countries have agencies that oversee the recovery of payments and they should keep a record of your payments. To protect yourself you should keep a personal record of all payments you receive.
If payments get lost or if the payer falls behind with payments, you will need to provide Courts Group with full details of overdue payments so that they can raise the matter with the relevant authorities. Courts Group does not keep a record of payments sent to you from abroad.
If you stop receiving payments, or if they are falling behind, you should tell Courts Group immediately. They will then contact the foreign authority to find out what has happened. You do not need to see a solicitor at this point as Courts Group will ask the foreign authority for help.
You are entitled to apply for an increase in your maintenance if you feel that your financial circumstances have changed since the order was made, and the payment is no longer enough. Of course, this option works both ways. If the person paying maintenance to you is worse off due to a change in their financial circumstances they can apply to have the payment reduced.
If you wish to take out an action for an increase in maintenance you should talk to a solicitor or advice centre.
