DRAFT BILL

The following section sets out the draft Bill together with a brief explanation of the general effect of the main provisions. The explanatory material is not intended to offer a comprehensive legal explanation of the sections. In each case, notes are provided on the page facing the Bill itself which are intended to explain the policy intention behind the sections.

The Bill has been prepared in the period since the appointment of the new Scottish Executive. Although care has been taken in its preparation, the Department will continue to work on the draft between now and introduction to ensure that it is a coherent and complete reflection of the policy intention of the Executive. In addition, as indicated in the introductory section to this consultation paper, the version of the Bill that is introduced may deal with matters not included in this draft.
