COMMUNITY SERVICE BY OFFENDERS (SCOTLAND) ACT 1978
Summary
1. This Circular gives notice of the date from which
particular Sheriff Court Districts may make Community Service Orders or Probation orders
which include a condition of unpaid work.
Background
2. Sections 183(5A)(b) and 384(5A)(b) of the Criminal
Procedure (Scotland) Act 1975, as amended by Section 7 of the 1978 Act, provides that a
court shall not make a Probation Order, with unpaid work as a requirement, unless it has
been notified by the Secretary of State that arrangements exist for persons who reside in
the locality where the offender resides, or will be residing when the Probation Order
comes into force, to perform work under such an order.
3. I am accordingly directed by the Secretary of State to
notify the court under Section 7 of the 1978 Act, that arrangements will exist for persons
residing in the Sheriff Court districts of Forfar, Arbroath, Dundee, Perth and the
Stipendiary Magistrates Court in Glasgow from 1 April 1995, to perform community service
as a requirement of a Probation Order.
4. Please note that arrangements exist to perform community
service under Section 1 of the 1978 Act in all Sheriff Court areas in Scotland and that
reciprocal arrangements are in force for all areas in England and Wales.
