PAYMENTS OF INCOME SUPPORT AND RETIREMENT PENSION FOR PERIODS IN HOSPITAL

Income Support and Retirement Pension are affected in the following ways when a resident goes into hospital.

LA Part III accommodation

IS drops to £11.20 immediately on admission

RP drops to £11.20 immediately on admission

Independent sector residents placed by LA on or after 1 April 1993

[ an amendment will be made shortly to the Income Support regulations which will allow Residential Allowance to remain in payment for 6 weeks. This information is meant as a guide only and should not be seen as an authoritative statement of the law relating to Income Support and Retirement Pension.]

Residential Allowance withdrawn after 6 days; remainder of IS drops to £14.05 after 6 weeks. After 52 weeks drops to £11.20.

Basic rate RP drops by £11.20 after 6 weeks, other components remain in payment. After 52 weeks basic RP drops to £11.20.

Independent sector residents already resident on 31 March 1993 (ie residents with preserved rights to higher rates of IS)

If resident remains liable for charge, IS higher rates remain in payment for first 6 weeks. Then drops to £14.05 plus - if a retaining fee is payable - up to 80% of the higher rate IS. Drops to £11.20 after 52 weeks.

Basic rate RP drops by £11.20 after 6 weeks, other components remain in payment. After 52 weeks basic RP drops to £11.20.
