Chapter 4: Charges - Exemptions and Services Statutory/Manual References
Outline
1. The Regulations prescribe that HBs, NHS Trusts and DMUs shall recover NHS charges for services provided to overseas visitors except:

i. for those services which are exempt; and

ii. from those visitors who are exempt.

2. No NHS charges shall be made under the Regulations for:

i. out patient or day patient treatment or overnight observation at an A&E or Casualty Department (or in pre-treatment 'holding' wards attached to these departments);

ii. family planning services;

1989 Reg 3(bb)

iii. treatment of listed diseases (including sexually transmitted diseases);

iv. a patient who is detained or under guardianship, or receiving treatment ordered by a Court as a condition of probation; and

1989 Reg 3(e) & (f)

v. diagnostic test for the evidence of infection with HIV and counselling associated with the test and its results.

Extent to which exemption from NHS charges applies
3. As mentioned in Chapter 2, visitors from other EEA member states and from countries with which the UK has reciprocal health care agreements should be exempt from NHS charge for diagnosis of symptoms or signs which first occurred during the visit. They should also be exempt from any other NHS treatment required promptly for a condition which arose or became acutely exacerbated during the visit, or is later to become acutely exacerbated if not treated. 1989 Reg 4 (m) & (o)

Chapter 2

Interpretation
4. In terms this will mean that a overseas visitor from a EEA member state or reciprocal health care agreement country will be entitled to NHS care free at the point of delivery for A&E treatment, the limited exemptions set out elsewhere in the Manual and any related continuing care up to the point that their clinician decides that it is medically safe for them to return home. Chapter 4
5. For those overseas visitors from non-EEA member states or non-reciprocal health care agreement countries the entitlement to NHS care free at the point of delivery is restricted to A&E treatment and the limited exemptions set out elsewhere in the Manual. Chapter 4
