| Subsection (6) states that a transfer of shares which transfers control of a company which owns registered land is a transfer of land for value. However, subsection (7) states that this is not intended to invalidate any transfer of shares. Section 53: Provisions supplementary to and explanatory of section 52 Subsections (1) and (2) define family relationships for the purposes of transfers of land within families. Subsection (3) sets out additional definitions regarding what may be considered as same family relationships relating to trusts, partnerships and companies. Subsection (4) defines companies within the same group. Subsection (5) makes clear that references to the landowner in section 52(5) include any agent or person in whom the land is vested due to reasons of insolvency, incapacity etc. |
