Section 51: Deletion of community interest in land

Subsection (1) allows Ministers to delete an entry from the register of community interests if they are satisfied that circumstances have changed such that, were the application to be made again, it would be unsuccessful.

Subsection (2) provides that before any such interest is deleted, Ministers must allow both the community body and the landowner the opportunity to make representations regarding the proposed deletion of the community interest.

CHAPTER 3 ACTIVATION OF RIGHT TO BUY

Section 52: Right to buy activated when transfer of land is proposed

Subsection (1) provides that the right to buy land in which a community interest is registered is triggered by the landowner (or a representative) taking steps towards selling or transferring the land for value.

Subsection (2) states that the right to buy may only be exercised over certain types of holding. Subsection (3) defines a holding.

Subsection (4) sets out the types of transfer which will not trigger the right to buy.

Subsection (5) states the type of action which, when taken with a view to transfer land, will trigger the right to buy.
