DRAFT LAND REFORM (SCOTLAND) BILL: Consultation Paper

Subsection (2) allows Ministers to delete an entry from the Register where a community body no longer, or never did, satisfy the criteria as a community body.

Subsection (3) allows Ministers to acquire land which was acquired under this Part, by means of compulsory purchase, where a community body is no longer, or never was, entitled to purchase that land. Subsection (4) states that The Acquisition of Land (Authorisation Procedure)(Scotland) Act 1947 applies to any such compulsory purchase by Ministers under subsection (3).

Section 44: Register of Community Interests in Land

Subsection (1) requires that Ministers shall set up and maintain, a Register of Community Interests in Land. Subsection (2) sets out the information and documents which the Register shall contain. It also specifies that the Register shall be maintained in such a manner as to be suitable for public inspection.

Subsection (3) allows the community body to request that documents relating to its interest in land, which fall within the definition in subsection (4), need not be made public, nor entered in the Register.
