| Subsection (3) confirms that the members of these local access forums shall be appointed by the local authorities. Subsection (4) requires local authorities, to have regard to certain matters, listed at (a) and (b), prior to making appointments to these local access forums. These are to ensure that all relevant interests are represented on the forum. Subsections (5) and (6) confirm that a local authority may appoint one or more of its own members to these forums and that the local authority can establish one or more local access forums for their area. Section 27: Register of land in respect of which access rights are not exercisable Subsection (1) places a duty on local authorities to establish, maintain and make available to the public, during office hours, a register of land on which access rights are not exercisable. Subsection (2) requires that land registered under subsection (1) should be made by reference to its location and not its type or nature. Subsection (3) makes it clear that local authorities must not charge for viewing of this register but can make a reasonable charge should anyone wish to receive a copy of the register. Section 28: Certificates of status of land Subsection (1) places a duty on local authorities to issue a certificate, on request, which should state that the piece of land specified in the certificate is subject to the right of access or is excluded from that right. Where an order has been made under section 10(1)(b) to (d) the certificate should state the extent to which the rights are exercisable. Subsection (2) clarifies that the certificate will not determinative of the matters stated in it . Subsection (3) confirms that these certificates will be in such a form as prescribed by regulation made by the Ministers by a statutory instrument. Subsection (4) explains the category of the statutory instrument, which will be passed by the Scottish Parliament, (i.e. subject to annulment in pursuance of a resolution of the Scottish Parliament). Subsection (5) allows the local authorities to make a reasonable charge for issuing these certificates. |
