| Subsection (9) amends section (28) paragraph (g) of the Land Registration (Scotland) Act 1979. This to ensure that the definition of "overriding interests" in that Act, in relation to "rights of way", now include a reference to the exercise of access rights, in respect paths delineated in a path order, created under this Bill. Section 22: Ploughing of paths This section clarifies that where an owner needs to plough land, which incorporates a path delineated by way of an order, then there is nothing in this Bill which prevents him from carrying out this work. Subsection (2) places a duty on landowners who have carried out any ploughing on land under subsection (1) to notify then relevant local authority within 7 days after the ploughing and within 8 weeks after the ploughing, or a longer period as the local authorities may allow, reinstate the path. Subsection (3) confirms that a landowner who does not comply with the requirements in subsection (2) (a) or (b) shall be guilty of an offence and liable to the fines specified in (3) (a) or (b), respectively. Subsection (4) further clarifies that if the landowner fails to comply with the requirements within subsection (2)(b) then the local authority may, after giving the landowner 14 days notice of their intention, take the steps necessary to reinstate the path, and to recover their reasonable expenses from the owner. Subsection (5) confirms that the provisions in this section do not prejudice limitations or conditions having effect otherwise. Section 23: Pasturing of bulls in land crossed by paths This section clarifies the responsibility being placed on the owner of land where there is a path delineated by a path order, in relation to the presence of a bull in their charge. Subsection (2) confirms the category of bull which is exempt from this section. Section 24: List of core paths Subsection (1) places a duty on local authorities to prepare and list of all the core paths within their area. |
