DRAFT LAND REFORM (SCOTLAND) BILL: Consultation Paper

Subsection (2) clarifies that any byelaws made under this section may confine the exercise of any activity (including boats) to specific parts of inland waters detailed in the byelaws and also prohibit the exercise of any other activity in that part of inland water.

Subsection (3) defines the use of the term " conserving natural beauty" which is used in subsection (1)

Subsection (4) applies the procedural requirements in sections 202 to 204 of the Local Government (Scotland) Act 1973 to any byelaws made under subsection (1) of this Bill.

Subsection (5) defines "boat" and "inland waters" for the purposes of this section.

Section 13: Procedure for making byelaws under section 12

This section sets out the procedures for making byelaws.

Subsection (1) requires local authorities, prior to making any byelaws, to publicise them in a manner they think fit and to make them available for public inspection for a period of no less than 12 weeks. They must also consult with those people and organisations listed in subsection (2).

Subsection (2) details all those people that local authorities must consult with prior to making any byelaws to ensure that all those with an interest in the proposed byelaws and those which are representative of these interests or representative of those who live, work, carry on business or engage in a recreational activity on the land in question, have a right to be consulted and to object to any propose byelaws.
