DRAFT LAND REFORM (SCOTLAND) BILL: Consultation Paper

Subsection (2) clarifies that any byelaws made under this section shall not interfere with any existing rights of navigation or of any functions of other statutory undertakers or port authorities or the running of the telecommunications industry.

Subsections (3) and (4) place duties on local authorities to publicise any proposed byelaws in a manner that they think fit, to make them available for public inspection for at least 12 weeks and to consult with all those listed in subsection (4).

Subsection (4) lists all those who local authorities must consult with in the prescribed period prior to making any byelaws. This is to ensure that all those who have an interest in the land or are representative of those with an interest, or those who live, work carry on business or engage in a recreational activity in or on land over which byelaws are being made, have a right to object to them should they wish.

Section 12: Byelaws about inland waters, including access to them

This section sets out the provisions relating to local authority powers to make byelaws to manage access to inland water for the purposes of this Bill.

Subsection (1) details the byelaw making powers that are to be given to the local authorities to manage the activities of the public while exercising their rights on inland water.
