| Subsection (2) requires local authorities to consult with such interested parties as they think appropriate, including the owner of the land in question, and to publicise the intended effect of any proposed order, prior to making the order. Subsections (3) and (4) provides that the order must specify its duration and, if that period is more than 30 days then it must be confirmed by the Ministers. Subsection (5) places a duty on local authorities to send any objections received in relation to the order to the Ministers. Subsection (6) places a duty on the Ministers, prior to confirming any order; to consider any objections they receive, and provides that they may hold an inquiry to enable them to make their decision before confirming the order. Subsection (7) applies section 265 (2) to (13) of the Town and Country Planning (Scotland) Act 1997 to any inquiry held under subsection (6) (b). Subsection (8) explains that the Ministers may confirm an order with or without modifications or refuse to confirm it. Subsection (9) confirms the date on which an order made under this section will take effect. Subsection (10) clarifies that the local authorities also have the power to revoke, amend or re-enact any order made by them under this section. Section 11: Byelaws in relation to land over which access rights are exercisable This section provides local authorities with powers to make byelaws over land on which the access rights in this Bill are excisable. Subsection (1) confers this power and details the reasons why such byelaws may be made. |
