| Subsection (7) clarifies that where access rights are excisable under subsection (6), the public path creation agreement, public path creation order, or public path diversion order, which established the path will be treated as path agreement, or as the case may be, a path order within the meanings given by sections 20 and 21 of this Bill. Subsection (8) defines the reference to "relevant byelaws" in subsection (1)(j)(iii) as being byelaws made by; a local authority, a water authority, and the British Waterways Board, under the legislation listed in (a) to (c). Section 5: Conduct excluded from access rights This section sets out those conduct, which is outwith the right of access conferred by this Bill. Subsection (1) confirms that access rights do not extend to a person being on land when that person is subject to the legal proceedings specified, is committing an offence or is doing something which is referred to in subsection (4). There are specific types of conduct that will be excluded under existing legislation. They are listed at subsection (5)(4)(l). These are conduct, which are specified by; local authorities in an order made under section 10 or in any byelaws, as prohibited conductor conduct which has the same effect in relation to access rights as conduct described in subsection (4) (a) to (l). |
