ENFORCEMENT OF CIVIL OBLIGATIONS IN SCOTLAND

CONSULTATION ARRANGEMENTS

The Scottish Executive has carried out a review of existing arrangements for the enforcement of civil obligations in Scotland. This paper sets out proposals for reform of the law of diligence and organisation of the enforcement system. We are asking for your views on a range of questions contained in the paper. Comments on the specific proposals set out in the paper should be made before 16 July 2002

Comments by e-mail would be preferred. An electronic form containing the full list of questions and a field for your comments can be accessed at the website detailed below and e-mailed to the above mailbox. A full list of the questions is also contained at Part 8 of the paper, and each question is highlighted in the appropriate section of the text. It would be helpful if, in responding, comments could be cross-referred to the question numbers in the paper although you should not feel you need to respond to all the questions. If you would like your responses to be treated as confidential, please indicate this clearly as all responses will otherwise be available for public scrutiny at the Scottish Executive's library at Saughton House. Responses from those who reply in confidence will only be included in numerical totals, and names and text will not appear in the list of respondents or in any published analysis.

Further copies of the paper can be downloaded from our website at www.scotland.gsi.gov.uk/consultations/justice/CivOb-00.asp Requests for the paper in different formats will be considered.

A digest of the consultation responses and an analysis of their content will be produced following their consideration and will be available on the Scottish Executive website. www.scotland.gsi.gov.uk

We invite individuals and organisations to submit views and comments by 16 July 2002.
