Introduction: The Scottish Government recognises that the members of the Getting it right for every child (GIRFEC) Learning Community will be experienced practitioners and policymakers and that the greatest safeguard to the appropriate running of the Learning Community will be the principles and values, knowledge and standards that they bring from that background. Nevertheless, and particularly given that members may at times be discussing real cases involving real children, young people and their families, it would seem appropriate to set out some stipulations of use for the avoidance of doubt.
General Disclaimer: The GIRFEC Learning website and material relating to Government information, products and services (including that of Pathfinders and Learning partners), is provided 'as is', without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
We do not warrant that the functions or material contained in this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or represent the full functionality, accuracy, reliability of the materials. In no event will we be liable for any loss or damage including, without limitation, indirect or consequential loss or damage, or any loss or damages whatsoever arising from use or loss of use of, data or profits arising out of or in connection with the use of the GIRFEC Learning website.
Copyright: As with the Scottish Government main web-site, some of the information and publications on the Getting it right for every child (GIRFEC) Learning Community worksite are subject to Crown Copyright. For other use or if in doubt, further information is available from http://www.hmso.gov.uk/copyright.htm.
Members may reproduce material from the site for non-commercial purposes (e.g. for use in disseminating information about GIRFEC to colleagues or clients) so long as the source is acknowledged, and it is with the permission of the content owner. If members wish to substantially edit or otherwise alter such material rather than using it substantially verbatim, we would ask them to clear this via the content owner first. Members should note that where they upload documents to the site they have the option to mark this as being for use on the site only and if they wish to post material that may be sensitive, may wish to do so by uploading a document rather than by e.g. directly adding a comment. If you supply material you are licensing others to use it for the purposes of the Learning Community.
Data Protection & Privacy: Under no circumstances should this website be used to disclose any information that could identify an individual with whom a member has had contact in a professional/client relationship - including names, addresses and personal records. Whilst it is accepted that case examples can be useful to share for the benefit of sharing learning and communication, all details should be sufficiently anonymised that no individual is in any way identifiable.
Defamation and Inappropriate content: Only some of the material submitted is moderated in advance of being made public. In such cases there may be a time delay between submission and posting, and anything that is abusive, indecent, unlawful or defamatory will not be displayed. Members are personally liable for the content they submit. If any un-moderated content has been posted that can be deemed inappropriate (for any reason), offensive or defamatory in any way, we reserve the right to remove or edit such content. We also reserve the right to terminate the account of any members who may be posting inappropriate content, or breaching the Stipulations of Use in general.
Freedom of Information (FOI): Please treat all interaction with this website in full consideration of the Freedom of Information (Scotland) Act - and as such, only share and interact as appropriate. Please be aware that in the case of an FOI request any content, comments or postings that you submit may be subject to release.
Hyperlinking: We are not responsible for the content or reliability of the linked websites. Listing should not be taken as endorsement of any kind. We cannot guarantee that these links will work all of the time and we have no control over the availability of linked pages.
Intellectual property: Whilst this is a worksite to be used specifically for the sharing of information, materials and learning experiences, the copying of logos, images and materials accessed via this website is not permitted without prior approval from the relevant copyright owner. Specific permission must be sought prior to sharing materials out-with the GIRFEC Learning website, unless otherwise stated.
Passwords & Authorised access: Only approved users who have been directly and personally granted a unique user name and password by the website administrator are authorised to use the website. Users are not permitted to share their account or disclose their access details (specifically their passwords) with anyone else whomsoever. Such actions may result in the removal of access for the account(s) in question.
Removal of material and/or access: The Scottish Government reserves the right to edit or remove material placed on the site and also the right, although it does not expect to have to use it, to remove individuals from access to the site altogether.
Shared Files and Pages: We are not responsible for the content or reliability of the shared files or pages on this website. Materials shared, including shared web pages, blogs and discussion boards, should not be taken as endorsed by us in any way.
Virus protection: We make every effort to check and test material at all stages of production. It is always wise for you to run an anti-virus program on all material downloaded from the Internet. We cannot accept any responsibility for any loss, disruption or damage to your data or your computer system which may occur whilst using material derived from this website.
User Validation: We take in good faith that members are who they say they are, and that they are acting with the best of intentions in support of GIRFEC development and implementation, the GIRFEC Learning Community and its members. We also take it in good faith that they are working for the organisation specified, and, where the organisation's internal rules and procedures require, have their authorisation and blessing to participate in the Learning Community. Where an obvious official organisational email address has been supplied, this will be taken as sufficient evidence that users are not bogus. Where such an email address cannot be supplied, or where there is reasonable doubt, further steps may be taken by us, at our discretion, to validate users and the organisation for which they are working.
