5. Will everyone who comes into contact with a child or a protected adult through the workplace need to be a scheme member?
No. The Scottish Government is committed to producing clear, informative and accessible guidance that will enable employers to decide whether a position should be within the scope of the scheme or not. To achieve this, a working group has been established to inform the design of interim guidance on the Protection of Children (Scotland) Act that better meets the needs of employers. It is intended that this will form a foundation for the guidance that will be needed on the PVG Act. The assessment of whether a post falls within the scope of the scheme remains with the employer.
A range of supports to help employers with the assessment of whether a post falls within the scope of the scheme will be available. This will include training and guidance materials and telephone and web-based advice.
