Part 2 of the CJ&L Bill - Criminal law

Provisions within Part 2 of the Bill are designed to tackle serious organised crime. There are also a number of other criminal law measures.

Priorities

New serious organised crime offences are created in sections 25-28 along with provisions that create a statutory aggravation for offences linked to serious organised crime. Along with a new offence of possessing communication devices within prison (to tackle offenders who control their criminal activities from within prison), we consider this will help our criminal justice agencies in tackling serious organised crime.

Provisions will also create a new offence in relation to possession of extreme pornography.

Other measures

Provisions that will:

  • improve to how test purchasing and proof of age schemes operate in respect of crossbows and knives; and
  • clarify the ability of Scottish courts to deal with conspiracy to commit offences in other parts of the UK.
