Purpose of the circular: To draw attention to the implementation of the Police (Scotland) Regulations 2004 (SSI 2004/257) and accompanying Determinations and to the formal reinstatement of the ranks of Deputy Chief Constable and Chief Superintendent in terms of the Criminal Justice (Scotland) Act 2003 (Commencement No 4) Order 2004 (SSI 2004/240).

The Determinations made under these Regulations

Background: These Regulations have been made by Scottish Ministers under powers conferred on them by the relevant sections of the Police (Scotland) Act 1967 and Police Reform Act 2002 with the purpose of consolidating and amending the existing regulations. A brief explanation of the purpose of each of the regulations is provided in Annex 1.

Where appropriate the regulations confer specific powers on Scottish Ministers to make determinations in relation to pay, allowances and conditions of service. Details of these determinations are listed at Annex 2.

The regulations and determinations take account of agreements reached in the Police Negotiating Board in relation to police pay and conditions of service up to 31 December 2003. Agreements subsequent to that date which have been approved for implementation under a Scottish Executive Police Circular will remain in force and be promulgated in Regulations and Determinations in due course.

Section 75 of the Criminal Justice (Scotland) Act 2003 provided for the reinstatement of the ranks of Deputy Chief Constable and Chief Superintendent to police forces in Scotland. The Criminal Justice (Scotland) Act 2003 (Commencement No 4) Order 2004 (SSI 2004/240) gives effect to this from 25 June 2004.

A copy of this circular is enclosed for the Director of Finance in the police authority. Copies have also been sent to the Convention of Scottish Local Authorities, the police associations and the Accounts Commission.
