A consultation paper seeking views on potential changes to the way the Scottish Executive Justice Department collects and provides information and statistics about the civil justice system was launched on September 15, 2004 and closed on January 10, 2005.

Background

Clerks of court and other officials are required by law to provide certain information on the business of the civil law processes in Scotland to the Scottish Executive.

At present, this information is made generally available through the publication "Civil Judicial Statistics". This provides statistics and information on the civil law business of the sheriff courts, the Court of Session, the Scottish Land Court, and the Lands Tribunal for Scotland.

Why we are Consulting on Civil Judicial Statistics

The law requiring officials to provide certain information on court business is old, dating mainly from an Act of Parliament of 1869. The statistics have been published in their current format for many years.

It is thought that it is time to change this old system for a number of reasons. It is recognised that the way in which these statistics are currently made available is of limited use in allowing the Executive or anyone else with an interest to effectively monitor and evaluate policies, or procedures.
