FREE PERSONAL CARE GUIDANCE

As you may know, the Executive is currently reviewing its guidance on Free Personal and Nursing Care (CCD 4/2002).

In advance of issuing revised guidance, however, I wish to draw your attention now to section 2 of the current guidance, which states that food preparation is not included and can therefore be charged for if provided to people in their own home. This is inconsistent with Schedule 1 of the Community Care and Health (Scotland) Act 2002, which makes explicit that assistance with the preparation of food should not be charged for. The terms of the Act take precedence here and must of course be observed.

I regret that the guidance was misleading. The necessary correction will be made in the revise in due course. Meanwhile, I should be grateful if you would ensure that the terms of this letter are understood by those of your colleagues responsible for implementing the policy.
