Status: NHS Body
Established: 1960, under section 2 of the Mental Health (Scotland) Act 1960. When the Mental Health (Care and Treatment)(Scotland) Act 2003 came into operation the Commission continued; with changes in its constitution and additional powers, functions and duties. Additional duties were added by the Adults with Incapacity (Scotland) Act 2000.
Terms of Reference: The Commission has a statutory duty to protect people who may, by reason of mental disorder, be incapable of protecting themselves or their interests adequately.
