Terms of Reference: Considering the needs of the individual is a key message of the 2004 Act which aims to ensure that all children and young people are provided with the necessary support to help them meet their individual needs and to help them make the most of their education.
The education authority will have to prepare a new co-ordinated support plan for certain children (aged 3 and above) and young people. This will co-ordinate the support for those with additional support needs, arising from complex or multiple factors, who need a range of support from different services.
The 2004 Act introduced a new judicial body, the Additional Support Needs Tribunals for Scotland, to adjudicate where parents and the Education Authority cannot agree on certain matters related to co-ordinated support plans. From 14 November 2005, the Act bestowed a range of new rights on parents and young people, including the right to make an appeal, known as a reference, to the Tribunals.

Last Reviewed by Government: HMIE are reviewing the implementation of the 2004 Act. An interim evaluation report was produced in November 2006 and a final report will be published in Autumn 2007.
