Annandale East Ward Consulation

CONSULTATION ON NAME OF ANNANDALE EAST WARD, DUMFRIES AND GALLOWAY COUNCIL AREA

The Scottish Ministers have decided exceptionally to consult on the name of the Annandale East Ward in the Dumfries and Galloway Council area. I would like to emphasise that this consultation is restricted to the name which should be given to the Annandale East Ward and is not an opportunity to revisit the ward boundary review for the Dumfries and Galloway Council area.

The name "Annandale East" is contained in the Dumfries and Galloway (Electoral Arrangements) Order (SSI/2006/434). We are consulting on a draft amendment Order (copy enclosed) - The Dumfries and Galloway (Electoral Arrangements) Amendment Order 2007 - which proposes to rename the Ward "Annandale East" as either "Eskdale" or "Annandale East and Eskdale." This, however, does not preclude other names being suggested.

A copy of the Statutory Notice which will be placed in the Dumfriesshire Newspaper Group, the Eskdale and Liddesdale Advertiser and the Annandale Herald from 23 and 24 August 2007, is enclosed at Annex A. The Statutory Notice sets out the locations at which copies of the draft Order will be deposited for public inspection. Dumfries and Galloway Council has been asked to make a copy of this letter and the draft Order available at its offices (as indicated in the Statutory Notice) for inspection by members of the public for a period of 2 months beginning on 24 August 2007.

Next steps in the process

The Dumfries and Galloway (Electoral Arrangements) Amendment Order 2007

The Scottish Ministers make the following Order, in exercise of the powers conferred by sections 26 and 233 of the Local Government (Scotland) Act 1973[1] and all other powers enabling them in that behalf.

In accordance with section 26(2) they have sent copies of the draft Order to concerned local authorities, public authorities and community councils and have given public notice that the draft has been prepared and is available for inspection.

Citation, commencement and interpretation
1. -(1) This Order may be cited as the Dumfries and Galloway (Electoral Arrangements) Amendment Order 2007 and shall come into force on 2007.

(2) In this Order "the principal Order" means the Dumfries and Galloway (Electoral Arrangements) Order 2006[2].

Amendment of Schedule to the principal Order
2. -In the Schedule to the principal Order (Electoral Wards) in column 2 for the words "Annandale East" substitute the word "Eskdale".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Dumfries and Galloway (Electoral Arrangements) Order 2006 to change the name of Ward 13 from "Annandale East" to "Eskdale" ["Annandale East and Eskdale"].

While this Order is not subject to any parliamentary procedure, in terms of section 26 of the Local Government (Scotland) Act 1973, the Scottish Ministers published notification of the draft Order in the [Dumfriesshire Newspaper Group[3], Eskdale and Liddelsdale Advertiser and the Dumfries and Galloway Standard]. They also made the draft available for inspection at various Dumfries and Galloway Council offices. Interested parties had two months to make any representations to the Scottish Ministers regarding the proposed name and the Scottish Ministers duly considered such representations before making this Order.

CONSULTATION ON NAME OF "ANNANDALE EAST" WARD IN DUMFRIES AND GALLOWAY COUNCIL AREA

The Dumfries and Galloway (Electoral Arrangements) Order 2006 (SSI2006/434) listed Ward 13 as the "Annandale East" Ward. After consideration of representations received, the Scottish Ministers have decided to consult on an appropriate name for Ward 13. Notice is hereby given today, 24 August 2007, that the Scottish Ministers have prepared a draft Order - The Dumfries and Galloway (Electoral Arrangements) Amendment Order 2007 proposing that the Ward name should be changed from "Annandale East" to either "Eskdale" or "Annandale East and Eskdale"

Copies of the draft Order can be inspected during office hours at the offices of Dumfries and Galloway Council from 24 August 2007 onwards at:
