What is the Scottish Government seeking to achieve in this section?

This section seeks views on improving the efficiency and effectiveness of statute relating to implementation of Ministerial commitments on the operation of snaring, the protection of badgers, muirburn and technical issues relating to the operation of SSSI legislation.

What policy issues does this section of the consultation cover?

The main issues on which views are sought are:

  • implementation of an accreditation scheme for snare operators
  • a new offence of tampering with a lawfully set snare
  • knowingly causing or permitting acts which constitute an offence against badgers
  • the level of penalties which apply to specific offences against badgers
  • increasing flexibility in the use of muirburn
  • SNH powers on entry to land in relation to SSSI offences
  • mechanisms for merging and streamlining SSSIs
  • operations on SSSIs permitted by public bodies
