The Scottish Government believed that past processes needed to be radically simplified.

The Government considered that there were 2 basic possible approaches with the final authorisation either at Ministerial level or at local level. Under either option the procedures had to ensure :

  • That the rights of those entitled to object under planning law and those entitled to object under the 1961 Act are maintained.
  • The flood risk management measure would have to be submitted with sufficient details for the all relevant issues to be considered.
  • The requirements of the environmental impact assessment directive were met.

This sub-group provided advice on the development of the Bill provisions for each option to achieve a workable, fair and simplified process.
