Time Limits

Under legislation time limits are usually given for lodging an appeal with Scottish Ministers. Time limits for lodging an appeal are usually set out in the regulatory authority's notice against which you may wish to appeal.

It is important that the parties meet these requirements, although in some cases it is open to Scottish Ministers to agree to longer periods.

Typical examples of time limits for lodging an appeal are:

  • Sewerage (Scotland) Act 1968 section 48(1)(a) - survey for a sewer: 14 days from the receipt of notice
  • Environmental Protection Act 1990 section 15 - EPA authorisation: 6 months from the date of the decision/date of new authorisation
  • Environmental Protection Act 1990 section 43 - Waste Management Licence: 6 months from the date of the decision/date of new Licence
  • Pollution Prevention and Control (Scotland) Regulations 2000 - regulation 22(1) - refusal of permit - 6 months from the date of the decision
  • Water Environment (Controlled Activities) (Scotland) Regulations 2005 - regulation 46(c) - aggrieved by Terms and Conditions attached to authorisation - 3 months from the date of the decision
