• (Modifications replacing references to water and sewerage authorities with references to Scottish Water)

The Water Services etc. (Scotland) Act 2005 (2005 asp 3)

• Strengthened the economic regulation of the Scottish water industry including setting up the Water Industry Commission, made provision regarding competition in the water industry, and strengthened customer representation.

• Section 26(10) - sewerage codes. [Has only been partially commenced in relation to any sewerage nuisance to which the Sewerage Nuisance (Code of Practice) (Scotland) Order 2006 (SSI 2006/155) applies].

• Schedule 5, para 7(5)- repeal of section 40 2002 Act (water and sewerage charges exemptions power).

• (Providing for a right of reference for Scottish Water requiring the WIC to refer its determination of SW's charges to the Competition Commission)

• (Appointing days for the commencement of certain provisions of the above Act)

The Water Services Charges (Billing and Collection) (Scotland) Order 2006 (S.S.I 2006/71)

• (Makes provision for link between the billing and collection of water charges with Council Tax)

The Water and Sewerage Charges (Exemption and Reduction) (Scotland) Regulations 2006 (SSI 2006/72)

• (Provided for exemptions and reductions from liability for charges between the financial years 2006 to 2010 inclusive).

The Provision of Water and Sewerage Services (Reasonable Cost) (Scotland) Regulations 2006 (SSI 2006/120)

• (Made provision in relation to the calculation of reasonable costs of connection to the public water supply and sewerage systems)
