Does our application require a CAR license?

linesmenThe Water Environment (Controlled Activities) Regulations [ CAR] 2005 came into force on 1 April 2006. The Regulations introduced specific controls which impact on the water environment, for example concerning engineering works, such as water crossings and point source pollution, in order to meet the requirements of the EC Water Framework Directive (2000/60/EC) as implemented by the Water Environment and Water Services (Scotland) Act 2003. Under CAR, developers are required to seek an authorisation/license from SEPA where a project is likely to impact on the water environment. SEPA has a statutory duty to determine whether the benefit of a development justifies the social and economic impacts as well as impacts on the environment.
