Modernising Planning

Scotland's planning system is undergoing the most significant modernisation in over 60 years. The Planning etc. (Scotland) Act 2006 is a landmark piece of legislation. The changes introduced by the Act are substantial and work is underway to implement the provisions of the Planning Act.

The changes to primary legislation in form of the Act part of the wider package of modernisation set out in the White Paper Modernising the Planning System, which was developed following an extensive programme of consultations and stakeholder engagements on all aspects of the planning system.

Aims

The Scottish Government aims to deliver a modern planning system that is:

  • Efficient: up to date development plans to be at the heart of an efficient system that provides certainty for users and local people
  • Inclusive: local people to be more involved in the decisions that shape the development of their communities
  • Fit for purpose: with a clear sense of priorities, and to address different issues in different ways
  • Sustainable: development to contribute to economic growth that is sustainable. Planning will deliver sustainable development ensuring development is in the right place, and of, the right quality
Implementation timetable

Work has already begun to implement the provisions of the Planning Act. The implementation timetable sets out the anticipated dates for consultation and commencement of legislation.

Circular 2/2008: Statutory Guidance on Strategic Development Planning Authorities, published on 23 April 2008, is issued under section 4(7) of the 2006 Planning Act, and planning authorities will be legally obliged to have regard to it. It advises on governance issues and provides guidance for planning authorities on strategic development planning authorities (SDPAs) and on how and where SDP area boundaries should be drawn.

The changes to primary legislation in The Planning etc. (Scotland) Act 2006 form part of the wider package of modernisation set out in the White Paper Modernising the Planning System, which was developed following an extensive programme of consultations and stakeholder engagements on all aspects of the planning system. The package in the White Paper will make Scotland's planning system fit for purpose, more efficient, more inclusive and more sustainable.

A brief guide to the provisions in the Planning etc. (Scotland) Act 2006 has been produced to set out what each part of the Act will do. This supplements the explanatory notes to the Planning Act which set out in detail the purpose of each section.

The Planning etc. (Scotland) Act 2006 list of commencements lists sections of the Act that come in to force from 1 April 2007.

A Modernising Planning presentation, with speaking notes attached, is also available to help communicate the aims of modernisation and the key changes that are being introduced.

The Planning Bill was carefully examined by the Scottish Parliament during the three parliamentary stages, involving the Communities Committee and the whole Parliament.
