DPEA Guide to Data Protection
The Government is committed to an open, transparent and accessible process for reaching decisions on planning appeals. The information submitted to Scottish Ministers concerning an appeal has always been publically available. However, in the vast majority of cases where a decision is still under consideration we now publish all of that material to the internet. This includes forms, correspondence, any associated documentation (including maps and drawings) and any correspondence that was previously submitted to the Planning Authority. This means that we will publish the content of any letters of objection or support received in relation to the proposal.

Our objective in providing this service is to ensure compliance with the Data Protection Act 1998. Thus we remove personal e-mail addresses, personal telephone numbers and personal signatures before publication to the internet. We remove most documents from the internet 12 weeks after the decision is made.
We aim to ensure that anything that is abusive, indecent, unlawful or defamatory is not displayed. However, individuals must take personal responsibility for the comments that they make and submit.
