Enforcement

Enforcement is the responsibility of local planning authorities and brings unauthorised development under control. Any unauthorised development or breach of planning permission should be dealt with quickly, efficiently and rigorously. For most enforcement queries, your local planning authority should be your first point of contact.

Policy summary

Planning Advice Note (PAN) 54: Planning Enforcement provides advice whereby action taken to enforce decisions should be appropriate to, and reflect the scale of, the breach of planning control. The key aims of enforcement are to:

  • remedy the effects of unauthorised development
  • bring unauthorised development under control

Enforcement is currently under review. Commencement of the enforcement provisions under the Planning etc. (Scotland) Act 2006, and associated designation orders and regulations will begin by the end of 2008.

Work is also under way to remove minor developments and granted permitted development rights from the current planning system. New regulations setting out this framework were the subject of a full public consultation which closed in February 2008.

Enforcement Charters: each Planning Authority is required to produce an Enforcement Charter setting out their policies for planning enforcement and how the public can report suspected breaches.

Enforcement Registers: each Planning Authority is required to keep a register listing all formal enforcement action they have undertaken. The Register is open to inspection by the public.
