For planning rules to be effective, they must be adequately enforced. In doing so, we not only protect our cities, towns and countryside, we protect your rights. Enforcement makes sure that developments have the necessary planning permissions and are in line with any conditions which have been set.
Your council is responsible for this enforcement. It can decide what action to take, but the action should rectify or reconcile the problem that breaking the planning rules has caused. If a council does not take suitable action, it can be reported to the Commissioner for Local Administration in Scotland (Ombudsman).
If a problem was caused by breaking the rules, councils have the power to issue notices detailing the action needed to correct it. Failure to act on these notices is a criminal offence.
