Listed buildings and conservation area consent

Row of old housesYou have the right of appeal to Scottish Ministers where a Planning Authority:

  • refuses consent for works to a listed building
  • issues listed building consent subject to conditions
  • refuses an application to vary or discharge conditions attached to a listed building consent
  • does not decide your application within two months
  • serves a listed building/conservation area enforcement notice
  • refuses conservation area consent

Please note if you are appealing against listed building or conservation area consent and you are not the sole owner of the building/land, you must give notice to everyone who, 21 days before the submission date of the appeal, was an owner of the appeal site. The appropriate notice(s) and further instructions is found with the Notes for listed building and conservation area consent appeals.

To submit an appeal electronically use the Online Appeal and Application System or download a listed building/conservation area consent appeal form or a listed building/conservation area enforcement notice appeal form and submit it by e-mail.

Call in of applications for listed buildings consent

Where a planning authority intends to grant an application for listed building consent for an alteration to, or extension of, a category A or B listed building, or an application to demolish a listed building, Historic Scotland must be notified. Scottish Ministers may, on advice from Historic Scotland, deal with the application themselves ('call in' the application). Cases which are called in are allocated to a reporter who will make a report and recommendation to Ministers.
