You have the right to appeal to Scottish Ministers where a planning authority:
- refuses hazardous substances consent or grants it subject to conditions
- does not decide the application within two months
- serves a hazardous substances contravention notice
Hazardous substance consent is required to keep certain substances on land at, or above, specified controlled quantities. The consent regime allows the hazards and risks which the hazardous substance may present to people in the surrounding area to be fully accessed and considered.
