Either a landlord or tenant can object to a fair rent that has been registered by a rent officer. The rent officer will refer the case to the Private Rented Housing Panel, which is independent of the Rent Registration Service.
The Panel will take account of the same matters as the rent officer and may confirm, raise or lower the rent.
A tenant can appeal about a fair rent if they:
- Are a regulated tenant (that is, have a tenancy that began before January 2, 1989)
- Were a secure tenant of a housing association and the tenancy was converted to a Scottish secure tenancy in September 2002
The Private Rented Housing Panel can also set market rents (that is, the amount of money that tenants in that area are prepared to pay) for short assured tenancies and terms and / or market rents for statutory assured tenancies.
- Assured Tenancy - Generally, a tenancy that started after January 2, 1989
- Short Assured Tenancy - A tenancy will be of this type if it started after January 2, 1989 and if an AT5 notice stating that the tenancy is short assured has been received or the tenancy is for less than six months. If this is not the case, then the tenancy will probably be an assured one.
