Arrangements for compensating producers for certain costs incurred on affected sheep enterprises as a result of the requirement to have sheep live monitored and/or marked before authority to move the sheep is granted.

Phase IV

Sheep producers in areas subject to movement restrictions under the Food and Environmental Protection Act 1985 may obtain consents to move animals, subject to certain conditions.

They should apply to their local Area Office for the consent on each occasion they wish to move sheep. Local Scottish Government staff will advise on whether or not it is possible to live monitor all of the animals which are to be moved.

Those which show readings below the action level may be moved: those which show readings above the action level must be marked before they are moved with a distinctive mark to indicate that they may not be slaughtered unless and until authorised by the Agriculture Ministers. If, on the other hand, individual monitoring of animals going to market and/or out of the restricted areas cannot be carried out, all the animals must be marked before they are moved. Irrespective of which of these monitoring arrangements apply producers who present their sheep to the monitor and/or have the sheep marked before consent to move them is issued will be eligible to claim compensation of £1.30 for each sheep monitored/marked and moved under consent.

Eligibility to apply

You are eligible to apply for compensation if:

  • Your sheep were kept on land within an area designated by an order made under the Food and Environment Protection Act 1985 and still so designated on the date the sheep were monitored and/or marked in accordance with instructions from the Agriculture Department

and

  • Your sheep were moved under the authority of a consent following monitoring and/or marking.

If you satisfy the above conditions, you can claim compensation on animals monitored and/or marked and moved under consent. This will help you complete Section A - "Arrangements for compensating producers from areas under restriction for losses incurred on sheep sold at auction and live-weight certification centres under the mark and release arrangements."

Phase II (Revised)

Arrangements for compensating sheep farmers for any market losses incurred on marked animals sold at auction and liveweight certification centres under the mark and release arrangements. The arrangements are basically the same as those assessed on an individual lot basis and that assessment will be undertaken in liveweight certification centres as well as in auction markets.

Producers in areas subject to movement restrictions under the Food and Environment Protection Act 1985 should apply to their local Area Office for consent to move animals. Local Scottish Government staff will then advise on whether or not it is possible to live monitor all of the animals which are to be moved. If this is possible then those which show readings below the action level may be moved: those which show readings above the action level must be marked before they are moved with a distinctive mark to indicate that they may not be moved unless and until authorised by the Agriculture Ministers. If on the other hand individual monitoring of animals going to market and/or out of the restricted areas cannot be carried out, all the animals must be marked before they are moved.

The Government have acknowledged that producers selling marked animals under these arrangements may receive lower market prices because they are selling animals which are subject to a slaughter restriction whose duration is not precisely known. Compensation is payable for such market losses, and those notes describe the details and application procedures.

How to apply for compensation

You should apply on form SCS19, which will be available from your local Area Office or your local auction market but which will be issued to you at the same time as the consent to move marked animals to market. Please complete a separate form for each market/day at which you sell sheep eligible for compensation.

You should ensure that you receive from the auctioneer an authenticated statement of the number of marketed animals sold. This will help you to complete section B of the claim form.

It is important that you attach these documents and a copy of the sales invoice to your completed application form.

Where and when to apply

Submit your completed claim SCS19 to the Department at Room 251, Pentland House, 47 Robb's Loan, Edinburgh accompanied by the necessary supporting documents. Claims should be lodged within one calendar month of the date of sale.

Applicant's undertaking

In signing your application you will be signing an undertaking to repay any over-payment as a civil debt, if required to by the Scottish Ministers. If it is subsequently established that the number of animals claimed is more than the number eligible, the Department will recover the sum paid for the ineligible animals.

Note

The Department reserves the right to withhold or suspend compensation payments in relation to transactions which they do not consider to be genuine, or whether they do not consider that payment would be consistent with the aims of the compensation scheme.

Restrictions on colour marked animals
