CONCLUSION
47. Action to protect and improve the water environment in Scotland is being taken under the Water Environment and Water Services (Scotland) Act 2003 and the Water Environment (Controlled Activities) (Scotland) Regulations 2005. SEPA has the leading responsibility for the classification of water bodies and for the development of river basin management plans in co-operation with other responsible authorities and other stakeholders. The classification and the river basin management planning processes are underpinned by the standards set in the Water Framework Directive, the Groundwater Directive of 1980 and the two daughter Directives.
48. The existing Scottish legislation meets many of the requirements of the two daughter Directives. We propose to complete the transposition of each by:
- adding both Directives to the list of Directives which the Scottish Ministers, SEPA and other responsible authorities are required to comply with in exercising their functions;
- amending the definition of hazardous substances; and
- amending the lists of Directives and of Regulations that SEPA must take into account in determining applications to carry out activities that are a potential threat to the water environment ('controlled activities').
49. We propose, following this consultation, to lay the Regulations (at Annex A) in the Scottish Parliament with a view to their coming into force in the autumn of 2009.
