2 The ECJ has stressed that 'undue delay' must be based on a clinical assessment of the individual clinical circumstances of the patient, and needs to be kept under review while the patient is waiting for treatment. The ECJ has said that offering treatment within a national waiting time target does not necessarily avoid "undue delay".

4 There is likely to be an impact on the private health sector from this Directive, although it is difficult to quantify at this stage. We have asked a question in the consultation document and have raised the issue in the initial impact assessment. This consultation would welcome information on the likely impacts.
