CRIMINAL PROCEDURE (SCOTLAND) ACT 1995 (AS AMENDED)
AVAILABILITY OF DRUG TREATMENT AND TESTING ORDERS
1. The purpose of this Circular is to notify extension of availability of Drug Treatment and Testing Orders (DTTOs) in respect of individuals normally resident within the sheriff court districts of Edinburgh, Haddington, Peebles, Selkirk, Jedburgh, and Duns whose cases are dealt with by a JP court in one of those districts. In effect, this covers all the JP courts in the local authority areas of Edinburgh, Midlothian, East Lothian and Scottish Borders.
2. Provision for DTTOs is contained in sections 234B - 234K of the Criminal Procedure (Scotland) Act 1995, as inserted by sections 89-95 of, and Schedule 6 to, the Crime and Disorder Act 1998. In addition, section 47 of the Criminal Justice (Scotland) Act 2003 inserted section 234CA into the 1995 Act. This provides for remote monitoring as a condition of a DTTO.

3. It should be noted that as of Monday 2 June 2008, arrangements exist to allow a Drug Treatment and Testing Order to be made available for offenders normally resident within the local authority areas of Edinburgh, Midlothian, East Lothian and Scottish Borders,whose cases are dealt with by a JP court. Please also note that this circular does not replace previous circulars on the availability of DTTOs, which are extant.
