Requests for action
40. Any person who is affected or likely to be affected by 'environmental damage'; or who otherwise has a sufficient interest may notify the appropriate authority of any 'environmental damage' which is being, or has been caused or of which there is an imminent threat of damage occurring
41. The authority will not need to take any further action if in its opinion the information does not disclose any genuine imminent threat or 'environmental damage'. Therefore sufficient information should be provided to show that there is plausibly an imminent threat or 'environmental damage'.
42. The authority may ask for further information about the imminent threat of damage, or of the possible 'environmental damage'.
Before taking any decision, the authority must, if practicable:
i) notify the responsible operator concerned of the notification and the accompanying information; and
ii) request the operator to submit his comments on the information
