Cost recovery
37. Subject to any relevant defences, the authority shall recover the costs it has incurred from the operator responsible for the damage or the imminent threat of damage. They include but are not limited to: the costs of assessing damage or imminent threats or alternative remedial options, administrative, legal and enforcement costs, data collection and other general costs and the costs of monitoring and supervision.
