Duties of authorities

Duty to investigate

28. When the authority has been notified of an imminent threat or of damage, the authority must carry out investigations

  • to establish the responsible activity and operator
  • to assess the damage or imminent threat.

Written assessment

29. The authority must produce a written assessment of the damage or risk, confirming whether there is environmental damage or an imminent threat and give a copy to the responsible operator

Cost recovery

30. Authorities must recover costs incurred in enforcing action for cases that prove to be imminent threats or 'environmental damage'. Where the authority takes preventive or remedial action itself, it must recover its costs from the responsible operator where known, except where satisfied a defence applies.
