10. Multi party causation
Chapter 10 explains what the arrangements are for cost allocation where two or more operators are responsible for 'environmental damage'.
10.1 Multi-party causation encompasses situations both where:
i) there are multiple emissions or events leading to 'damage', for example where two or more operators discharge pollutants into one water body;
ii) one emission or event leads to 'damage' but two or more operators are responsible for it, for example where one party has produced the polluting product that another party has used.
10.2 In cases of multi-party causation, the authority may enforce requirements and reclaim the costs associated with the imminent threat or relevant damage from any one of the operators responsible or from such other person as it considers liable for those costs. That party can then pursue others for a contribution for their share of the liability.
